This document is a legally binding agreement between you ("User", "you", "your") and Ek Sanatan Puja ("Ek Sanatan Puja", "ESP", "Company", "we", "our", "us"). By accessing or using the Ek Sanatan Puja website, mobile application, or any related digital service (together, the "Platform"), creating an Account, or placing a Booking, you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and any Service-specific terms displayed on the Platform.
IMPORTANT NOTICE ON THE “EK SANATAN UPHAAR”: Wherever a Service includes the “Ek Sanatan Uphaar,” this is a courtesy devotional gift package provided by ESP. IT IS NOT THE PRASAD OF THE PUJA AND IS NOT REPRESENTED, CERTIFIED, OR GUARANTEED TO BE A BLESSED RITUAL OFFERING. Clause 21 below explains this in full and forms an essential part of these Terms.
Ek Sanatan Puja is a platform that enables devotees to digitally discover, book, and pay for religious, spiritual and devotional services performed by independent temples, priests and other service providers, and to access ancillary spiritual-guidance and devotional-commerce services described in Clause 6.
By (a) browsing or using any part of the Platform, (b) creating an Account, (c) placing a Booking, or (d) making any payment through the Platform, you acknowledge that you have read, understood and agree to be legally bound by these Terms, the Privacy Policy, and any applicable Service-specific terms. If you are accessing the Platform on behalf of a business, organisation, or another individual, you represent that you are authorised to bind that entity or person to these Terms.
ESP is a technology intermediary. It operates the booking, payment, communication, logistics-coordination and customer-support infrastructure through which Users may access Services performed or supplied by independent Temple Partners, Priests, astrologers, consultants, logistics partners and other Service Partners.
Except where a Service is expressly described as being performed directly by ESP, ESP may or may not directly engage any Priest, and does not own or operate any temple. ESP may accept Bookings, collect payments, and issue invoices or receipts as agent for collection purposes only; this does not make ESP the performer of the underlying religious Service.
Nothing in these Terms creates any partnership, joint venture, agency (other than limited payment-collection agency expressly stated), franchise, fiduciary or employment relationship between ESP, on the one hand, and any Temple Partner, Priest, astrologer, logistics partner or User, on the other.
ESP undertakes reasonable, commercially standard onboarding and verification steps in respect of Service Partners, and intends to enter into formal written agreements with every Temple Partner and Priests prior to onboarding. However, ESP does not independently verify, and does not guarantee, every representation, qualification, lineage claim or credential asserted by a Service Partner, and makes no warranty as to the religious authenticity, denominational correctness, or ritual validity of any Service.
“Account” means the registered user account created by a User on the Platform.
“AI Astrology / AI-Generated Content” means astrology, Kundli, horoscope, numerology, Vastu or similar output generated wholly or partly through automated or machine-learning systems, with or without human review.
“Ek Sanatan Uphaar” means a devotional gift package that may be offered by ESP in connection with certain Services. For eligible Users located within India, ESP may, at its sole discretion, dispatch the Ek Sanatan Uphaar on a complimentary basis. For Users located outside India, the Ek Sanatan Uphaar shall be made available only upon the User's express opt-in and payment of the applicable additional charges, if any. ESP reserves the right to determine the eligibility, contents, availability and dispatch of the Ek Sanatan Uphaar from time to time. For the avoidance of doubt, and as elaborated in Clause 21, Ek Sanatan Uphaar is NOT the Prasad of the specific Puja/Services provided by ESP and carries no representation of ritual sanctity.
“Booking” means a confirmed request placed by a User through the Platform for a specific Service.
“Chadhava” means an offering requested by a User to be made to a temple, deity or religious institution through a Service Partner.
“Devotee / User / you / your” means any natural person who accesses or uses the Platform, creates an Account, or places a Booking.
“E-Store” means the online marketplace feature of the Platform through which spiritual and devotional products are sold, which may be supplied by ESP or by third-party sellers.
“Grievance Officer” means the officer designated by ESP under Clause 50 and, where applicable, applicable Indian law, to address User grievances.
“Platform” means the Ek Sanatan Puja website(s), mobile application(s), APIs and any other digital interface owned or operated by ESP.
“Priest” means a priest/poojari, religious officiant or other person engaged by, or associated with, a Temple Partner to perform a religious Service.
“Prasad” means a blessed devotional offering that has formed part of, or been consecrated during, the actual performance of a Puja or ritual, and which is expressly identified as “Prasad” in the relevant Service Description.
“Sankalp Details” means the name, Gotra, Nakshatra, Rashi, date of birth, prayer intention, family member names and any other information submitted by a User for the performance of a Puja or religious Service.
“Service” means any Puja, Seva, Homam, Havan, Abhishek, Archana or other religious ritual, Chadhava, Live Darshan, AI Astrology or spiritual-guidance service, E-Store product, membership/subscription, or devotional/educational content made available through the Platform.
“Service Description” means the details, inclusions, exclusions, date, time, location, price and other conditions displayed for a specific Service on the Platform at the time of Booking.
“Service Partner” means collectively, any Temple Partner, Priest, astrologer, consultant, logistics/courier partner, payment service provider, or other independent third party involved in performing or supporting a Service.
“Taxes” means GST and any other applicable indirect taxes, duties, cess or levies.
“Temple Partner” means a temple, trust or religious institution associated with ESP for the provision of Services through the Platform.
Words importing the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.
You must be at least 18 years of age and possess the legal capacity to enter into a binding contract under the law of your country of residence to create an Account, make a payment, or place a Booking in your own name. A parent or lawful guardian may create a Booking, submit Sankalp Details, or use the Platform on behalf of a minor. In such cases, the parent or guardian is solely responsible for the accuracy of information submitted, the Booking, and all payment obligations, and represents that they hold the legal authority to act for the minor.
By using the Platform, you represent and warrant that:
you have the legal capacity and authority to accept these Terms;
all information you provide is accurate, current and complete;
where you submit information relating to another living or deceased person (including for Sankalp), you are authorised to do so and have obtained any consent required by applicable law;
you are not barred from using the Platform under the law of the jurisdiction from which you are accessing it, and are not a person to whom provision of the Services would be prohibited under applicable export-control, trade-sanctions, or anti-money-laundering laws.
Certain Services require registration and creation of an Account. Registration and login may be verified through One-Time Password (OTP) sent via SMS or WhatsApp, and account recovery may similarly be conducted through WhatsApp-based OTP verification.
You agree to:
provide accurate, current and complete registration information and keep it updated;
maintain the confidentiality of your login credentials, Account access, and any OTP sent to you, and not share these with any third party;
not permit any other person to access or use your Account;
notify ESP immediately upon becoming aware of any unauthorised access to, or use of, your Account; and
remain responsible for all activities conducted through your Account, except to the extent such activity occurs after you have promptly reported unauthorised access to ESP and ESP has had a reasonable opportunity to act on that report.
ESP may refuse registration, or may suspend or terminate an Account, where it reasonably suspects fraud, misuse, unlawful activity, security risk, or a breach of these Terms, in accordance with Clause 39.
Subject to availability, and to the terms of this Clause 6, the Platform enables Users to access:
Online Puja, Seva, Homam, Havan, Abhishek and Archana booking;
Digital Chadhava;
Ek Sanatan Uphaar dispatch, where applicable;
Live Darshan at select temples;
AI Astrology, Kundli and Horoscope services;
Vastu and Numerology consultations;
Festival Special Pujas;
an E-Store for spiritual and devotional products;
Membership and subscription plans; and
devotional content and educational resources relating to Sanatan Dharma.
The display of a Service on the Platform, including in marketing material, does not guarantee that it is currently available, that it will remain available, or that it is available in every location or country. ESP may add, modify, suspend, discontinue, or vary the scope of any Service or feature at its discretion, subject to honouring existing confirmed Bookings and applicable law.
Availability of any Service depends on factors outside ESP's control, including Temple Partner and Priest availability, religious calendars and festival schedules, logistics and delivery coverage, and technical or operational feasibility.
Services are performed or supported by independent Service Partners, each of which may follow its own religious tradition, procedure, timing and method. Accordingly, and without limiting Clause 32 (Religious Services Disclaimer):
ritual duration, sequence, language and procedure may differ between temples and Priests;
a specific Priest cannot always be guaranteed;
rituals may be performed individually or collectively, as stated in the Service Description;
temple timings may change owing to festivals, religious observances or administrative requirements; and
reasonable regional and customary variations in pronunciation, recital, sequence or method may occur.

A Booking is placed by selecting a Service, submitting the required details, and completing full payment, unless specified otherwise. A Booking is confirmed only when (a) full payment has been successfully received, and (b) ESP has issued a Booking confirmation. All Bookings are subject to Service Partner availability, temple schedules, religious requirements, and operational feasibility.
ESP may reject, cancel or reschedule a Booking where: the relevant Temple Partner or Priest is unavailable; the temple is closed or unable to perform the Service; performance is prevented by a religious, legal, technical or operational restriction; there is a pricing, listing or payment error; the Booking is suspected to be fraudulent or unlawful; or circumstances beyond ESP's reasonable control prevent performance. Where ESP cancels a confirmed Booking before the Service is performed, the User is entitled to a refund of the amount paid for the affected Service, in accordance with Clause 16.
Users must review the applicable Service Description, including temple name/location, ritual type, individual/collective nature, scheduled date, required Sankalp details, whether livestream/photographs/recording are included, whether Prasad, an Ek Sanatan Uphaar, or delivery is included, price, and any Service-specific cancellation conditions, before placing a Booking. The Service-specific conditions displayed at the time of Booking form part of, and prevail over, these Terms only to the extent of any conflict for that specific Booking.
Users are solely responsible for the accuracy and completeness of Sankalp Details submitted. ESP will use reasonable efforts to communicate submitted Sankalp Details to the relevant Service Partner, but is not responsible for errors or omissions in information supplied by the User, changes requested after the applicable cut-off time (if any), minor pronunciation differences, regional or customary variations in recital, or the omission of optional information not provided by the User. Requests to modify Sankalp Details must be submitted before the Service cut-off time; ESP cannot guarantee that any modification is possible after Booking confirmation or after preparations have commenced.
The relevant Temple Partner or Priests performs the religious Service according to its own traditions, customs and religious practice. Unless expressly stated in the Service Description, ESP does not guarantee the appointment of a particular Priests, performance at an exact time, an exact ritual duration, a particular sequence, language or method of worship, an individual (rather than collective) ritual, physical attendance by the User, or the provision of photographs, livestream or recording. Reasonable variations in religious practice do not, by themselves, constitute non-performance or a deficiency in Service.
All payments must be made through the payment methods displayed on the Platform, which include PayU, UPI and bank transfer, and are processed by independent, RBI-regulated payment aggregators/gateways or banks pursuant to formal agreements with ESP. ESP does not ordinarily store complete card, UPI or banking credentials, and payment data is handled by the relevant payment service provider in accordance with applicable data-security standards (including PCI-DSS, where applicable).
The amount displayed at checkout may include the consideration for the Service, Chadhava or devotional-offering amounts, applicable Taxes, delivery charges, and any other charge disclosed before payment. No additional charge will be imposed after payment unless clearly disclosed and accepted by the User. Where an amount is debited but the Booking is not confirmed, the User should contact Customer Support with the transaction details; ESP will verify the transaction and coordinate with the payment provider, but is not responsible for delays attributable to the payment provider or the User's bank.
All prices are exclusive of applicable Taxes unless expressly stated as inclusive. ESP will issue electronic invoices or receipts in accordance with applicable tax law. Users are responsible for providing correct billing details at the time of Booking and ESP is not obliged to amend an invoice after issuance except as required by law.
ESP is not responsible, and no refund is payable, where a Service cannot be properly completed or accessed because of an act, omission or error attributable to the User, including: incorrect or incomplete Sankalp Details (name, Gotra, date of birth, prayer intention); an incorrect or incomplete delivery address; failure to submit information within the required time; a late modification or cancellation request; failure to attend or access a livestream at the notified time; failure of the User's own device, internet connection or software; breach of temple rules or Service instructions; refusal to cooperate with reasonable verification; or dissatisfaction based solely on the absence of an expected religious, personal, medical or financial outcome.
Where a Service is not performed, is materially incomplete, or materially differs from the Service Description because of a verified fault attributable to the relevant Temple Partner, Priests or Service Partner, the User may submit a refund request within 3 days of the scheduled performance or completion of the Service, stating the Booking/order number, a clear description of the issue, and any reasonable supporting information requested by ESP.
Where the complaint is verified, ESP will provide a full refund where the affected Service was not performed at all, or a proportionate refund where the Service was partly performed or only a specific paid inclusion was not provided, determined reasonably having regard to the nature of the Service and the portion actually performed.
No refund will be granted merely because a User did not obtain the spiritual, personal or other outcome they expected; the ritual method differed from the User's personal preference; minor customary or regional variations occurred; or the complaint was made after the 7-day period without reasonable explanation.
Approved refunds are initiated to the original payment method, ordinarily within 7 business days of approval. The time for the refunded amount to reflect in the User's account depends on the User's bank or payment provider and is outside ESP's control. Non-recoverable transaction charges levied by a bank or payment provider may be deducted from the refund, except where prohibited by law.
A User may request cancellation or rescheduling before the relevant Temple Partner or Priests has commenced preparation for the Service. A full refund is available where the cancellation request is made at least 72 hours before the scheduled commencement of the Puja. Rescheduling requested (of any available Services within the same price range) within 48 hours of commencement, or after preparations have commenced, is subject to operational feasibility and any Service-specific condition displayed at Booking, and may not be eligible for a refund.
Once a ritual has begun or the Service has been completed, the Booking is not ordinarily eligible for cancellation or refund, except as provided in Clause 15 or under applicable law. Where a User is not satisfied with how their Sankalp was incorporated into the Puja, ESP will, at the User's election, either reschedule the Puja of the User's choice or process a full refund, subject to verification. A cancellation request does not take effect until confirmed by ESP.
Where a Puja is delayed, the User will be notified. Where feasible, ESP will offer rescheduling, an alternative arrangement, or a refund in accordance with Clause 15, having regard to the cause of the delay.
Where a Booking includes Chadhava or another devotional offering, the offering is arranged through the relevant Service Partner. Once the offering has been procured, transferred, presented or used for its intended religious purpose, the corresponding amount is not refundable. ESP does not represent that any Chadhava or devotional payment qualifies for tax deduction or charitable benefit unless expressly confirmed in writing, with a receipt issued by an eligible institution.
Livestreaming, photographs and recordings are provided only where expressly stated in the Service Description, and Live Darshan - as may be available only at select temples, subject to availability. Where livestreaming is included, the scheduled time may be approximate due to temple procedure; access may depend on temple permission and technical availability; temporary interruptions may occur due to internet, electricity, equipment, crowd or temple restrictions; and ESP does not guarantee uninterrupted or broadcast-quality streaming. All Live Puja sessions that are streamed will be recorded for the User's viewing where applicable.
Any livestream or recording provided is for the User's personal, non-commercial devotional use only, and must not be reproduced, sold, altered, or misrepresented as content owned or produced by the User. Where an expressly included livestream or recording is not provided owing to a verified fault attributable to ESP or a Service Partner, the User may seek a proportionate refund under Clause 15.
The Ek Sanatan Uphaar is a complimentary devotional gift package. It is NOT the Prasad of the Puja, is not consecrated during, or as part of, the performance of the ritual, and carries no representation, warranty or guarantee of religious, ritual or spiritual sanctity, authenticity or significance.
Where a Service Description mentions dispatch of a “Ek Sanatan Uphaar,” the User acknowledges and agrees that:
for eligible Users located within India, the Ek Sanatan Uphaar is offered on a complimentary basis and does not form part of the paid consideration for the Puja;
for Users located outside India, the Ek Sanatan Uphaar shall be made available only upon the User's express opt-in and payment of the applicable additional charges, if any. The international dispatch of the Ek Sanatan Uphaar is a logistics and delivery service only and shall be subject to the applicable delivery timelines, shipping terms, customs requirements, refund, return, cancellation and other policies communicated on the Platform from time to time;
its contents are selected at the discretion of ESP and may vary from time to time and between temples, festivals or regions;
dispatch of the Ek Sanatan Uphaar is subject to availability, serviceability of the delivery address, and logistics feasibility, and its non-dispatch or delay does not, by itself, constitute non-performance or deficiency of the underlying Puja;
no refund is payable solely on account of non-delivery, delay, or variation in the contents of a Ek Sanatan Uphaar , except where the Service Description expressly priced the Ek Sanatan Uphaar as a separately paid, guaranteed inclusion; and
where a Service separately and expressly identifies an item as “Prasad” (as distinct from the Ek Sanatan Uphaar ), that item alone is treated as Prasad for the purposes of these Terms, and Clause 22 applies to it.
The User further acknowledges that the Ek Sanatan Uphaar and its constituent items are curated, sourced, packed and/or supplied by independent third-party manufacturers, vendors, artisans, logistics partners and other service providers engaged by ESP. While ESP endeavours to engage reputable third-party partners and exercise reasonable care in the curation and dispatch of the Ek Sanatan Uphaar, ESP does not manufacture, produce or independently verify each constituent item and, to the maximum extent permitted under applicable law, disclaims all representations and warranties relating to the quality, merchantability, fitness, specifications, authenticity or suitability of such items. Any defect, variation, damage or delay attributable to such third-party manufacturers, suppliers or logistics partners shall be governed by the applicable terms of such third parties, and ESP's liability, if any, shall be limited to the extent expressly provided under these Terms and applicable law.
ESP reserves the right to withdraw, modify, or discontinue the Ek Sanatan Uphaar offering, in whole or in part, at any time without liability, subject to honouring the terms of any Booking in which a Ek Sanatan Uphaar (or Prasad) was expressly and separately sold as a paid inclusion.
Where a Service expressly includes delivery of Prasad or a Ek Sanatan Uphaar , the contents and nature of the package are as described in the Service Description, subject to Clause 21. The User is responsible for providing an accurate, complete and serviceable delivery address and contact number.
Delivery is undertaken through third-party logistics partners, including Delhivery, Blue Dart, DTDC, India Post, Maruti Logistics and BSA Couriers. Delivery timelines are estimates only and may be affected by temple schedules, festivals and public holidays, courier operations, weather, government restrictions, location limitations, or other circumstances beyond reasonable control.
Minor variations in appearance, quantity, packaging or presentation arising from ESP or logistical requirements do not constitute a defect. Owing to the devotional, blessed, consumable or perishable nature of certain items, returns are not accepted; however, a User may report a materially damaged, incorrect, or undelivered package within 3 days of delivery. No refund or replacement is payable where delivery fails because the User supplied an incorrect address, refused delivery, or was unavailable despite reasonable delivery attempts.
E-STORE — SPIRITUAL AND DEVOTIONAL PRODUCTS
The E-Store enables Users to purchase spiritual and devotional products, which may be supplied by ESP directly or fulfilled by third-party sellers or Temple Partners identified on the relevant product listing. Product images, descriptions, weights, dimensions and colours are indicative and provided on a best-efforts basis; minor variations between the listing and the delivered product do not constitute a defect.
E-Store products (other than perishable, consecrated, or customised items) may be returned or exchanged only for a materially damaged, defective, or incorrect item, reported within 3 days of delivery, and are governed by the return window and process stated on the relevant listing at the time of purchase. Any manufacturer's warranty on an E-Store product runs from the relevant manufacturer or seller and not from ESP, except to the extent ESP is the seller of record.
The Platform may offer AI-generated or expert-assisted astrology reports, horoscope services, Kundli analysis, numerology, and Vastu guidance. Such Services are based on traditional interpretive methods, astronomical/astrological calculation, and information supplied by the User; may be generated or assisted by automated or machine-learning systems without full human review; may contain differences in interpretation, errors, or inaccuracies (including AI-generated inaccuracies commonly described as “hallucinations”); and are provided strictly for informational, spiritual and devotional purposes.
THESE SERVICES DO NOT CONSTITUTE MEDICAL, LEGAL, FINANCIAL, INVESTMENT, PSYCHOLOGICAL, OR OTHER PROFESSIONAL ADVICE/GUARANTEE. Users must not base significant medical, legal, financial, employment, matrimonial, travel or personal decisions solely on these Services. No refund is payable merely because a prediction, recommendation, or expected outcome does not materialise, and ESP disclaims liability for any decision made in reliance on such output to the fullest extent permitted by law.
Festival Special Pujas are subject to temple-specific festival schedules, higher-than-usual demand, and possible last-minute changes owing to religious observance or civic/administrative restriction (such as crowd-control measures).
Where offered, the applicable price, duration, benefits, usage limitations, renewal conditions and cancellation procedure will be displayed before purchase. A subscription auto-renews only where the User has expressly selected or accepted an auto-renewal option, in accordance with applicable law on recurring/auto-debit payments. A User may cancel future renewal through the method made available on the Platform; cancellation stops future renewal charges but does not, by itself, entitle the User to a refund for the ongoing subscription period. ESP may reasonably vary future membership benefits or pricing, with communication of any material change affecting an existing paid period where required by law.
Devotional, religious and educational content relating to Sanatan Dharma made available on the Platform is provided for informational and devotional purposes only, reflects the perspective of its author(s) or contributor(s), and does not constitute a definitive or exclusive statement of religious doctrine. ESP does not warrant the theological, historical, or scriptural accuracy of any third-party or user-contributed devotional content.
Users must: provide accurate and complete information; use the Platform only for lawful, personal, non-commercial purposes; respect religious practices, temples, Priests and other Users; follow reasonable temple and Service instructions; maintain the security of their Account; and comply with these Terms and all applicable law.
Users must not: create a false Account or impersonate another person; submit false payment, identity, or Booking information; misuse discounts, referrals or promotional offers; use stolen, unauthorised, or invalid payment credentials; upload unlawful, defamatory, obscene, hateful, or offensive content; interfere with the security, integrity or normal operation of the Platform; introduce malware, viruses, or harmful code; access or attempt to access restricted systems or data; scrape, crawl, reverse-engineer, or commercially exploit Platform content without permission; misuse livestreams, photographs, or recordings; use automated means (bots) to place Bookings for resale or speculative purposes; or use the Platform in a manner that harms ESP, a Service Partner, or any other person.
Breach of this Clause entitles ESP to take action under Clause 39 (Suspension and Termination), in addition to any other remedy available at law, including recovery of losses caused to ESP or a Service Partner.
Uploading a photograph or other content to the Platform is voluntary and not mandatory, except where a specific Service expressly requires it. By submitting any photograph, text, review, or other content to the Platform, the User grants ESP a non-exclusive, worldwide, royalty-free, sub-licensable licence to use, reproduce, display and process that content solely for the purpose of providing the relevant Service, operating the Platform, and any customer-support, quality-assurance or promotional use expressly consented to by the User. The User represents that they own or are authorised to grant this licence in respect of any content submitted, and that such content does not infringe any third party's rights.
The Platform and its contents, including the ESP name, logo, software, design, graphics, icons, text, devotional content, videos, photographs, databases, and source code, etc. are owned by, or licensed to, ESP and are protected under applicable intellectual-property law. Users receive only a limited, revocable, non-exclusive, non-transferable licence to access the Platform for personal, non-commercial use.
Users may not, without ESP's prior written permission: copy, reproduce, or distribute Platform content; commercially exploit any content; reverse-engineer the Platform; remove copyright or proprietary notices; create derivative works from ESP content; or use ESP's name, logo, or branding in a misleading manner. Rights in temple names, images, rituals, and third-party content may belong to the relevant Temple Partner, Service Partner, or licensor and are used by ESP under licence or with permission.
Religious rituals, prayers, Chadhava, astrology, and spiritual practices are matters of individual faith and belief. NEITHER ESP NOR ANY SERVICE PARTNER GUARANTEES: fulfilment of a wish or prayer; financial success or business growth; employment or professional advancement; marriage or relationship outcomes; childbirth or fertility outcomes; recovery from illness; examination or academic success; visa, travel, or governmental approval; or any other spiritual, personal, medical, financial, or material outcome. The absence of an expected result does not, by itself, establish that a Service was not performed or was deficient.
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE EXCLUDED.
The Platform relies on independent third parties, including Temple Partners and Priests, astrologers and consultants, payment gateways and banks, courier and logistics providers, cloud/hosting providers, telecommunications providers, and SMS/email/WhatsApp/analytics providers. ESP is not responsible for an interruption or failure caused exclusively by an independent third party and beyond ESP's reasonable control. Where a verified failure by a Temple Partner, Priests, or Service Partner materially affects a paid Service, the matter is addressed under Clause 15.
Nothing on the Platform, including AI Astrology, Kundli, Vastu, numerology, devotional content, or any communication from Customer Support, constitutes medical, legal, financial, tax, investment, or psychological advice. Users should consult an appropriately qualified professional before making decisions in these areas.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESP, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL LOSS, INCLUDING LOSS OF PROFIT, OPPORTUNITY, GOODWILL, ANTICIPATED BENEFIT, OR EMOTIONAL OR SPIRITUAL EXPECTATION.
To the extent permitted by law, the User agrees to indemnify, defend and hold harmless ESP, its directors, employees, and representatives from and against all losses, claims, costs, damages, and liabilities (including reasonable legal fees) arising from: the User's breach of these Terms; fraudulent or unlawful use of the Platform; false or misleading information submitted by the User; use of another person's information without proper authority or consent; infringement of intellectual-property, privacy, or other third-party rights by the User; misuse or unauthorised distribution of recordings or Platform content; or violation of applicable law by the User.
A Temple Partner, Priests, astrologer, logistics partner, or any other Service Partner is not a party to, and has no direct rights or obligations under, these Terms as against the User, and vice versa, except as expressly stated.
ESP may suspend, restrict, or terminate a User's Account or access where the User: breaches these Terms; engages in fraud or unlawful activity; misuses payments, refunds, or promotional offers; infringes the rights of another person; compromises Platform security; behaves abusively towards ESP, a Service Partner, or another User; or creates legal, security, or reputational risk for the Platform. Where reasonably possible, ESP will provide notice before termination; immediate action may be taken in cases of fraud, security risk, unlawful conduct, or serious misuse.
A User may stop using the Platform at any time by deleting their Account. Termination does not affect completed transactions, outstanding payment obligations, rights accrued before termination, or any clause intended to survive termination, including intellectual property, disclaimers, liability, and indemnity provisions.
ESP is not responsible for delay, interruption, or non-performance caused by circumstances beyond its reasonable control, including natural disasters; floods, fires, or extreme weather; pandemics or public-health restrictions; government orders or legal restrictions; temple closures; religious or administrative restrictions; civil unrest, war, or terrorism; strikes or transportation disruption; electricity, telecommunications, or internet failure; cyberattacks; courier disruption; or failure of an essential third-party provider. Where reasonably possible, ESP may offer rescheduling, an alternative arrangement, or a refund for the unperformed portion of the affected Service.
ESP's collection, use, storage, and sharing of personal information, including Sankalp Details, religious information (Gotra, Nakshatra, Rashi, prayer intentions, family member names), photographs voluntarily uploaded by Users, and payment-related information, is governed by ESP's separate Privacy Policy, which forms an integral part of these Terms and should be read together with them. In the event of any conflict between these Terms and the Privacy Policy on a matter of data processing, the Privacy Policy will govern.
Where ESP processes personal data of Users located in India, it does so in accordance with the Digital Personal Data Protection Act, 2023 and rules made thereunder, including in its capacity as a Data Fiduciary. Users submitting Sankalp Details or other information relating to a third party (including family members) confirm that they are authorised to provide such information and, where required by law, have obtained the consent of that third party.
Personal information is retained only for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and maintain business records, as further detailed in the Privacy Policy. Data is stored on secure cloud infrastructure & as per ISO 27001 certification, and makes no representation that any other particular security certification is in place as of the Effective Date.
By creating an Account or placing a Booking, the User agrees to receive transactional and Service-related communications, including OTPs and verification messages (including via WhatsApp), Booking confirmations, payment receipts, Sankalp and Service updates, livestream or recording information, delivery updates, security alerts, and customer-support responses, sent through email, SMS, WhatsApp, telephone calls, or push notifications.
Promotional communications, including in relation to festival campaigns and new Service launches, will be sent in accordance with applicable law (including any applicable do-not-disturb/registration framework) and the User's stated preferences. Users may opt out of promotional communications at any time; necessary transactional communications will continue regardless of such opt-out.
The Platform uses cookies, analytics, and performance-monitoring technologies to operate, secure, and improve the website and mobile application, as further described in the Privacy Policy (which incorporates ESP's cookie practices). Continued use of the Platform after being presented with a cookie notice constitutes consent to such use, to the extent required by applicable law.
The Platform supports payments in multiple currencies. The currency displayed and the applicable charges shall be determined based on the User's location, payment method, or other criteria determined by ESP or its payment service providers. The User shall be responsible for making payment in the currency displayed at the time of checkout. Any currency conversion, foreign exchange rates, bank charges, card network fees or other charges levied by the User's bank or payment service provider shall be borne solely by the User, and ESP shall not be responsible for any fluctuation in exchange rates or any additional charges imposed by such third parties.
Physical delivery of Prasad, the Ek Sanatan Uphaar, and E-Store products is currently limited to India; international delivery may be introduced subject to customs regulations and logistics feasibility.
Services may be unavailable, restricted, or withdrawn, without liability to ESP, in any jurisdiction where: local law prohibits the provision of religious, spiritual, astrological or similar services; payment processing for that jurisdiction is not supported; or logistics, customs, or export-control restrictions prevent delivery. The User represents that they are not accessing the Platform from, and are not a resident of, any jurisdiction where such access or use would be unlawful, and that they are not subject to any applicable trade-sanctions or export-control restriction that would prohibit them from receiving the Services.
Where a User accesses the Platform from outside India, they remain responsible for compliance with the law of their own jurisdiction, including any foreign-exchange, import, customs, tax, or consumer-protection requirements applicable to them; nothing in these Terms is intended to displace any mandatory consumer protection available to a User under the law of their habitual residence.
For the purposes of the Consumer Protection (E-Commerce) Rules, 2020 and allied law, ESP discloses: its legal name and registered office address; that Services and E-Store products are offered by ESP directly and, where indicated on the relevant listing, by identified third-party sellers or Temple Partners; that expiry or validity information (where applicable to a Service or product) will be displayed on the relevant listing; and the contact details of its Grievance Officer and Customer Support set out in Clauses 49 and 50. ESP does not manipulate search results or discriminate between similarly placed Users in a manner prohibited by applicable law, and will not impose cancellation charges that are unreasonable or disproportionate to the nature of the Service.
These Terms, the Platform, and ESP's processing of information are intended to operate consistently with applicable Indian law, including the Information Technology Act, 2000 and rules made thereunder, to the extent applicable to ESP's operations), the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, the Digital Personal Data Protection Act, 2023, and applicable rules of the Reserve Bank of India governing payment aggregators and payment gateways.
ESP may update the Platform, Services, or these Terms to reflect changes in law, new or modified Services, security or technical requirements, operational changes, or business requirements. The updated Terms will be published on the Platform with a revised “Last Updated” date, and, where required by law, Users will be informed of material changes through the Platform or another appropriate communication method. Continued use of the Platform after the revised Terms take effect constitutes acceptance of the updated Terms. Changes will not retrospectively remove rights already accrued in relation to a completed transaction. Where we are required to notify you of any changes to these Terms, we shall make reasonable efforts to send such notification through your registered email address, or any other contact details provided by you. However, if such notification is not received due to reasons beyond our reasonable control, including but not limited to your blocking our communications, incorrect or outdated contact details, technical issues, device-related problems, network failures, or similar circumstances, such non-receipt shall not invalidate the effectiveness of the revised Terms.
These Terms are governed by, and interpreted in accordance with, the laws of India, without regard to conflict-of-law principles.
The parties will first attempt to resolve any dispute arising from these Terms or use of the Platform through ESP's grievance-redressal mechanism under Clause 49. If a dispute is not resolved within 30 days of a written complaint, the courts at Mumbai, Maharashtra will have exclusive jurisdiction.
A User may submit a complaint concerning a Booking, payment, Service, refund, or Platform issue to the Grievance Officer or Customer Support, stating the User's name and registered contact information, the Booking/transaction number, a clear description of the issue, and relevant supporting documents or evidence. A refund complaint concerning a Service-Partner-caused issue must be submitted within the 3-day period specified in Clause 15.
ESP will endeavour to acknowledge grievances within 48 hours and resolve them within a reasonable period, having regard to the nature and complexity of the complaint and applicable law.
For assistance concerning Bookings, payments, refunds, Sankalp Details, livestreams, deliveries, or technical issues, Users may contact ESP at support@eksanatanpuja.com or by telephone at 9691300222, Monday to Saturday, 10:00 a.m. to 7:00 p.m. IST, or through in-app support and WhatsApp where made available.
The User agrees that electronic acceptance of these Terms is legally binding; that electronic invoices, receipts, notices, and communications may be provided through the Platform or the User's registered contact details; and that records maintained electronically by ESP may be used to establish Bookings, payments, and communications, subject to applicable law.
Notices to ESP must be sent in writing to grievance@eksanatanpuja.com or to the registered office address stated in Clause 55. Notices to a User may be sent to the email address, phone number, or in-app notification associated with the User's Account, and are deemed delivered when sent, unless the User can show non-delivery due to a fault attributable to ESP.
ESP may engage independent vendors, contractors, and Service Partners to operate the Platform and facilitate Services, and may assign or transfer its rights and obligations under these Terms to an affiliate, successor, purchaser, or reorganised entity, provided such transfer does not unlawfully reduce the User's existing rights. A User may not transfer their Account or rights under a Booking without ESP's prior written consent.
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible, and the remaining provisions will continue in full force and effect.
A failure or delay by ESP in enforcing any provision of these Terms does not constitute a waiver of that provision or any other right. A waiver is effective only if made expressly and in writing.
Any feedback, suggestions, or ideas voluntarily submitted by a User regarding the Platform or Services may be used by ESP without restriction or compensation, and without any obligation of confidentiality, unless otherwise agreed in writing.
These Terms, together with the Privacy Policy and any Service-specific conditions displayed at the time of Booking, constitute the entire agreement between the User and ESP concerning use of the Platform and the relevant Service, and supersede all prior discussions or understandings on the subject. Where there is a conflict: the Service-specific terms displayed and accepted at the time of Booking prevail for that particular Service; these Terms otherwise govern use of the Platform; and the Privacy Policy governs the processing of personal information.
These Terms are drawn up in the English language. Any translation provided for convenience is not binding, and the English-language version prevails in the event of any inconsistency.
